Terms

This policy governs your use of the Lagree YYC Website (the “Website”). The Website is designed to allow users to create participant accounts, make class / series / contract purchases, register for classes, and communicate with Lagree YYC.  Please note that these Terms & Conditions including pricing and class schedule are subject to change without notice.


Minimum Age Requirements

We recommend that participants be at least 16 years of age as there is a degree of maturity and body awareness that is involved to get the maximum benefit out of the workout. That being said, participants as young as 12 can participate in a class at their parents’ discretion. Minors are required to have a parent or guardian execute a waiver before they can attend a class DOWNLOAD WAIVER HERE.


First Visit to Lagree

Please be advised that all first-time members are required to arrive no less than 15-minutes before their first class. This allows the instructor to provide participants with a thorough introduction to the unique and patented Megaformer. First-time members who fail to arrive in time for the instructor-led introduction will not be able to participate in the class.

We are pleased to offer Calgary and area residents their first class free! This must be your first “purchase” and cannot be applied retroactively.

Reservations / Charges

In order to make a reservation, you must have a class credit on your account. This can be in the form of a drop-in session, a class pack, or a membership contract. To buy an individual class or passes online, you can either sign up by using your email and creating a password by clicking on the button labelled “Sign-Up/Login” on the top right of the page. If you are already registered, click “Book Now/Login” to purchase classes and make your reservation.

Regularly priced drop-in and class packages do not expire (unless otherwise stated at the time of purchase) but will require an extension of 12 months after the purchase date. All passes are non-refundable, exchangeable, or transferable. All future prices are subject to change without notice. We accept Mastercard, Visa, and American Express online. However, in the studio, you are able to make payments by cash or debit.

Please note that you can sign up for regularly scheduled classes up to 1 week in advance online.

Your credit card will be charged for your order when you submit your reservation. Lagree YYC will not process reservations that use an incorrect, expired, or over-the-limit credit card. We will make our best effort to contact you if this occurs. If you fail to pay any fees or charges when they are due, services or privileges may be suspended or terminated.

 


Cancellation Policy

ALL SALES ARE FINAL. Classes and reservations are non-refundable, exchangeable, or transferable.

In order to cancel a reservation and return the pass to your account, you must cancel online at least 8 hours in advance. Once your reservation is cancelled, the class will be refunded to your account to be used at a future date. If you cancel later than 8 hours prior to the scheduled class time, your pass will not be refunded.

Members with a 2-week or monthly unlimited contract are subject to the same cancellation policy as stated above. Members who No-Show, Late Cancel or otherwise fail to participate in the class they are registered for will be charged a $20 no-show fee which will be charged to the card on file. For more information, please see our “Contract Rules” section below.

Reservations can only be cancelled by logging into your account, and next to the class you wish to cancel, press “cancel”. You cannot cancel your reservation by calling the studio or sending an email.


Waitlist Policy

If a class you’d like to take is full, we recommend that you add yourself to the waitlist. A class credit in the form of a single class, a class package or a membership is required before adding yourself to the waitlist. If you do not get a spot in your desired class, your credit will remain in your account for future use.

We have an 8-hour cancellation policy. If a spot becomes available 8 or more hours in advance of the scheduled class, you will receive an email &/or text message (depending on your account preferences) letting you know that you have been added to the class (please be sure to check your Junk or SPAM folder).

If you will not be available to receive notification (eg: went to bed, turned off your computer or cell phone), if you have registered in another class, if you got into another class from the waitlist or if your plans changed, please remove yourself from the class and /or waitlist by going online at least 8 hours in advance of the class start time. If you are waitlisted for multiple classes and get into a class, the system will not automatically remove you from the other waitlists. Please remove yourself manually from all the other waitlists.

If you have been added to a class and don’t decline or early cancel your spot in the class 8 or more hours in advance of the class, you will still be charged.

If you’re on a waitlist and a spot opens less than 8 hours before the class start time, you will not be added to the class. Therefore, we encourage you to check our schedule daily as space often becomes available on short notice. In this case, you can register for the class as you normally would.

 


Contract Rules

Members who have a Monthly Recurring contract or the First 2-Week Unlimited contract are entitled to register/attend a maximum of one regularly scheduled Lagree class per day.

A valid Mastercard, Visa, or American Express must be kept on file for all active accounts.

Members with a 2-week or monthly unlimited contract who No-Show, Late Cancel or otherwise fail to participate in the class they are registered for will be charged a $20 no-show fee. If the card on file is invalid, Lagree reserves the right to suspend the member’s contract and restrict class access until all outstanding fees have been paid in full. If you have any outstanding fees, you will not be able to attend or register for a class. You will also be removed from any classes which you have scheduled and your contract term will not be extended.

The option to purchase the 2-Week Unlimited contract is only offered after your first class. You cannot purchase this contract if you have purchased any other services, including ClassPass. The contract is 14 days long and will begin on the date of your first scheduled class using this payment option. It is non-recurring and is not eligible for suspension.

All recurring contracts commence upon purchase and will automatically renew each month following the activation date. To cancel or suspend any contract, please email [email protected] at least 5 business days prior to the scheduled monthly renewal date.

Recurring contracts of 4, 8, or 12 classes per month require a 1-month commitment and they are not eligible for suspension. Unused classes will expire at the end of the monthly period and cannot be carried forward. Members are entitled to attend 4, 8, or 12 regularly scheduled Lagree classes in a given 30-day period commencing the date that their contract was purchased. If a member exceeds their allocated classes in the 30-day period, they will be required to purchase a drop-in or a class package.

The recurring Monthly Unlimited contract requires a 3-month commitment and it may be suspended for a minimum of 2 weeks up to a maximum of 8 weeks per calendar year. If for any reason you must suspend your contract, you will be subject to a $25 admin fee per suspension.

The recurring Student Monthly Unlimited contract commences upon purchase and requires a 1-month commitment. This contract is not eligible for suspension.

The recurring Signal Hill Monthly Unlimited contract was a special offer associated with the grand opening of our Signal Hill studio and is no longer available for purchase. This contract can only be used at our Signal Hill studio and requires a minimum of a 6-month commitment. This contract may be suspended for a minimum of 2-weeks and up to a maximum of 8-weeks per calendar year. If you must suspend your contract, you will be subject to a $25 admin fee per suspension. Please note that once this contract is cancelled or suspended for more than 8-weeks, it cannot be reinstated.

 


ClassPass @ Lagree YYC

Lagree YYC is pleased to be a member of the ClassPass community!

  • Please be sure to familiarize yourself with the terms & conditions of ClassPass which are posted on their website.
  • All Lagree YYC terms & conditions as stated apply to ClassPass members.
  • If you attend your first class at Lagree YYC through ClassPass, you are not entitled to a first-class free from Lagree YYC as ClassPass provides new members with incentives (no double dipping).
  • ClassPass members who are new to Lagree YYC are entitled to purchase our 2-Week Unlimited contract or the special First Month Unlimited contract after attending their first class. To do this, please speak to a team member in-studio or email us at [email protected].
  • This can only be purchased after your first class (you cannot have purchased any other services including ClassPass).
  • For more information, please see the “Contract Rules” section above.
  • ClassPass members are required to contact ClassPass customer service for any issues or concerns related to their accounts or reservations.

Instructor Changes @ Lagree YYC

Lagree YYC reserves the right to substitute the instructor in a scheduled class with little or no notice with another Lagree certified instructor as required.


General Statement on Privacy, Personal Data, and Communications

If you use the Website, you are responsible for maintaining the confidentiality of your account, password, and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and password.

When you visit the Website, or communicate with Lagree YYC via email, you are communicating electronically. You consent to receive communications from Lagree YYC electronically. Lagree YYC will communicate with you by email or by posting notifications on the Website. You understand and agree that all agreements, notices, disclosures, and other communications that Lagree YYC provides electronically satisfy any legal requirement that such communications be in writing.


User Provided Information

Lagree YYC does not collect any personal information about individuals – such as names and postal codes, home addresses, and email addresses – except when such information is knowingly provided to Lagree YYC. Personal information might be obtained from online transactions such as class/series purchases, retail purchases, and/or class registrations. Additionally, personal information may be transmitted as part of a form submission or in connection with other activities or services made available on the Website. Any personal identification information retrieved by Lagree YYC must be voluntarily submitted by the user.

Lagree YYC may use the information provided to contact you with important information, required notices, and marketing promotions.


Automatically Collected Information

The Website may collect some anonymous information about users automatically when individuals request pages through a browser. This information is used to keep track of the shopping cart and to help us monitor how individuals use the Website, which allows Lagree YYC to provide an optimal experience and better service throughout the online offerings. The information collected automatically by the server does not contain anything that can identify individuals personally, such as an email or home address.


Security Statement

Lagree YYC makes every effort to ensure that all of the transactions that occur on the Website are secure. All credit card numbers and transactions are encrypted using 128-bit Secure Socket Layer (SSL) encryption. We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain.

For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve the Website. Please be aware that, although we endeavour to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.


What is a Secure Connection?

When a secure connection is established between your browser and a website, any data that is transferred over the connection will be encrypted to prevent it from being viewed by a third party. SSL encryption makes it very difficult for anyone to intercept or decode messages exchanged over this type of secure connection.

Browsers such as Internet Explorer, Firefox, and Safari display an image of a locked padlock on their status bar when connected to a secure site. Google Chrome shows a green locked padlock on the far left side of the status bar when there is a secure SSL connection. Firefox colors the address bar yellow when connected to a secure site. Secure transactions are also indicated when the prefix in the location bar of your browser switches from http:// to https://. The additional ‘s’ stands for ‘secure’ and indicates a secure connection to the Lagree YYC website. If you do not see this padlock, if it is unlocked, or if the protocol in the location bar is not listed as https://, then any data exchanged with the website is potentially visible to others.

Cookies

A cookie is a small text file that is sent to your browser from a website and stored on your computer’s hard drive. Cookies cannot read data from your hard disk or read cookie files that were created by other sites – the website that creates a cookie is the only one a browser will permit to access it.

Like many other websites and applications, the Website and App use cookies to obtain certain types of information. For example, Lagree YYC might use cookies to control access to certain features such as your password and account, to customize content areas, or to analyze site activity and user behaviour. Lagree YYC reserves the right to use cookies in the future in conjunction with new content or expanded functionality.

If you are concerned about the use of cookies, you can explore your web browser’s options to notify you whenever a cookie is set, or to disallow cookies altogether. You should be aware that prohibiting the use of cookies will significantly restrict access to certain types of content or features.


How Information is Used

The following are examples of how Lagree YYC might use the personal information collected through the Website:
If you purchase a Lagree YYC series, sign up for a Lagree YYC class, or purchase Lagree YYC retail items, the required personal information (similar to that provided during a telephone or mail order purchase) will be used to complete your order.
If you indicate that you are interested in receiving Lagree YYC related news and information, you may receive emails to the email address you provided as part of the registration process.

For the non-personally identifiable information collected throughout the Website:

  • Aggregate data could be analyzed to describe the collective characteristics and behaviours of online visitors, and subsequently be used to further optimize the effectiveness of the website, the mobile application, and the overall Lagree YYC experience.

You can help Lagree YYC maintain the accuracy of your personal information by updating your account. Please update this information when you change your address, phone number, or email address. Lagree YYC will never share telephone numbers, email addresses, or any personal data with third parties.

Lagree YYC reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders, at its sole discretion.


Privacy of Minors

If you are under 18, you may register and use the Website only with the involvement of a parent or guardian. Lagree YYC does not accept the online registration of minors; please do not attempt to register on the Website if you are under the age of 18. Registration of a minor (ages 16-17) must be completed in person at our studios with a parent or guardian. Minors (ages 16-17) who have submitted the Assumption of Risk, Waiver and Release Form signed by a parent or guardian (in person), may sign up for classes online.

If Lagree YYC discovers that personal information has been submitted by a minor without a signed participant/registration waiver, Lagree YYC reserves the right to delete such information. Lagree YYC does not seek or share personal information from minors throughout the Website.


Links / Third Party Websites

Lagree YYC has not reviewed all the sites linked to the Website, and is not responsible for the content or any off-site pages or other linked sites. Although a third party website may contain the Lagree YYC logo, please understand that it is independent from Lagree YYC, and that Lagree YYC has no control over the content of that website.

Going to third party or off-site websites from the Website is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with Lagree YYC.


Intellectual Property Rights

The trademarks and trade dress of Lagree YYC are proprietary to Lagree YYC and may not be used by you for any reasons other than as expressly permitted by these terms. All Website content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Ululo Incorporated (DBA: Lagree YYC). You have the right to view, electronically copy, and print in hard copy portions of the Website for the sole purpose of making class reservations, purchases, or other personal use.

Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of Lagree YYC, is strictly prohibited.

You acknowledge that Lagree YYC and/or third party content providers remain the owners of all Website materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms and Conditions. Lagree YYC may discontinue or remove the Website, or any portion thereof, or discontinue your right to use the Website, or any portion thereof, at any time.


Not Authorized to Perform Data Mining

You are not authorized without the prior written permission of Lagree YYC to use any computer code, data mining software, “robot,” “bot,” “spider,” “scraper” or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Website or accessed through this Website. You also may not engage in the mass downloading of files from this Website; use the computer processing power of this Website for purposes other than those permitted above; flood this site with electronic traffic designed to slow or stop its operation; or establish links to or from other websites to this Website.


Not Authorized to Use this Website for Commercial Purposes

Users are not authorized to sell, reproduce, distribute, modify, display, publicly perform, report or otherwise prepare derivative or second hand works based on any of Lagree YYC’s material in any way for any public or commercial purpose. Thus, you are not authorized to (i) resell or make commercial use of this site or its contents; (ii) collect or use any product listings, descriptions, photographs or prices displayed on this Website in connection with the sale or resale of any Lagree YYC products or for other commercial purposes; or (iii) create, reproduce and/or distribute any materials derived from the content provided on this Website. Furthermore, Lagree YYC’s material may not be displayed or communicated on any other website, in a networked computer environment or other digital support for any purpose whatsoever. In the event of breach of any of these Terms, User’s permission to use Lagree YYC’s material will automatically terminate and any copies made of Lagree YYC’s material must be immediately destroyed.

Any unauthorized use of Lagree YYC’s material may violate provincial and federal criminal laws, infringe copyright laws, trademark laws, the laws of privacy or publicity, and communication regulations and statutes.


Warranty Disclaimer and Limitation of Liability

In no event will Lagree YYC be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, or on any other linked/third-party website, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if Lagree YYC expressly advised of the possibility of such damage.

All information is provided by Lagree YYC on an “as is” basis only. Lagree YYC provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.


Choice of Law

The Website, and your use hereof, is governed by the laws of the Province of Alberta. Any claim arising out of your use of this Website must be brought in Alberta, Canada.

Lagree YYC is located in Calgary, Alberta Canada where all of our Virtual Live Stream classes are produced and our in-studio sessions are offered.  As such, all participants understand and accept that any and all services provided by Lagree YYC are subject to the laws and jurisdiction of Alberta, Canada.


Scheduling and Pricing Changes

Occasional changes may be made to our Schedule and Pricing policies without notice.  Should Schedule and Pricing modifications occur, said updates will be added to the Website and/or App to reflect changes in Lagree YYC’s policies.  By using the Website or App, you agree to be bound by any such revisions. Users of the Website and App are encouraged to check these resources periodically to stay informed of any changes and updates.

Occasional changes may be made to this document as new services and content are added to the Website or App to reflect changes in Lagree YYC’s policies. The Terms and Conditions may be revised at any time by updating this posting. By using the Website or App, you agree to be bound by any such revisions. Lagree YYC reserves the right to deny access to any person we deem to be acting in an inappropriate or unsafe manner. In addition, Lagree YYC protects the rights and freedoms of all people. Our studio is a safe and inclusive environment for everybody and every BODY. We will not tolerate discrimination in any shape or form. If any individual threatens the comfort or safety of our team members or other participants, Lagree YYC reserves the right to deny access. 


Acceptance of Terms

By using the Website and the services offered by Lagree YYC, you signify your acceptance of the Terms and Conditions herein. If you do not agree to this, please refrain from using the Website or using our services, including but not limited to our Virtual Live Stream and in-studio sessions.
